restriction into markets, abuse of dominance etc. Our expertise in domestic laws/ regulations and international antitrust
regulation includes innovative strategic advice on behavioural pattern of entities and assistance in litigation before
Competition Commission of India (CCI), Competition Appellate Tribunal (COMPAT) and other courts of judicature.
Our team applies economic principles in resolving complex competition law sector specific issues in consonance to the clients interest. We also advice our clients on existing agreements from possible competition law violations and undertake competition audits. We assist governmental departments and contemplated policy changes for the review of enforcement policies.
SCOPE OF WORK-
Filings and Representation-
We represent our clients before the Competition Commission and assist in filing applications for the clearance of
combinations where such exceeds the applicable threshold limit specified in the Act in terms of assets turnover.
Our practice in Antitrust Litigation includes representing clients in prosecuting as well as defending allegation of
cartelization, bid rigging, restriction in markets, leniency filings in cartel for reduction of fines, issues
pertaining to vertical restraints such as tie-in arrangement, non-compete, resale price maintenance etc. We also
represent our clients in abuse of dominance matters, private action suits, class action suits, combination/merger
related litigations and also modifications in conditionally approved mergers.
Documentation and Negotiations-
We deal in drafting and reviewing of non-compete agreements, non-disclosure agreements, employment agreements etc.
for matters pertaining to anti-competitive arrangements or abuse of dominance arising before Commission.
We provide advice on behavioural pattern of the enterprises/ transactions and undertake due diligence on CCI filing
requirements for the parties in the transaction and also review existing agreements for possible violations taking
into account the available exemptions in transactions.
