Why this handbook matters

Construction disputes demand an understanding of law, engineering, finance and project management together, yet lawyers and engineers often approach the same dispute from separate perspectives. Engineers may not see how contracts allocate risk or how tribunals assess delay, defects and damages. Lawyers may not grasp the technical choices on site that shape timelines and costs. When that gap widens, disputes escalate instead of settling, and stalled projects delay essential infrastructure and affect the wider economy.

Inside the Handbook

Part I Contracts, Procurement and Project Risk

Contracting arrangements, public procurement, delay, “no damages for delay”, variations, ground conditions, design liability, subcontractors and the legislative framework.

Part II Liability, Security, Termination and Damages

Securities, insurance, liabilities, claims, limitation of liability, termination and formula-based damages.

Part III Dispute Resolution Framework and the Arbitral Process

Dispute resolution under standard forms, mediation and institutional arbitration, claim avoidance, the arbitration agreement, stamping, selection of tribunals, conduct of proceedings, preliminary applications and interim relief.

Part IV Evidence, Hearings, Awards and Enforcement

Procedural orders, evidence and expert evidence, hearing preparation, awards, award writing, enforcement and challenges, and online dispute resolution.

02 — ABOUT THE BOOK

A WORKING REFERENCE FOR CONSTRUCTION DISPUTES

This Handbook on Construction Arbitration is organised in the order how a construction dispute unfolds. It starts with how projects are procured and contracted, then covers the issues that most often generate claims: delay, variations, ground conditions, design liability, securities, insurance, termination and the quantification of damages. The second half moves to the dispute resolution process itself: drafting the arbitration agreement, constituting the tribunal, conducting proceedings, handling evidence and expert evidence, preparing for the hearing, writing the award, and enforcing or challenging it.

The discussion is anchored in the contractual and procedural instruments that govern construction projects in practice. The FIDIC Red, Yellow, Silver and White Books, NEC, the MoRTH Model Concession Agreement, the CPWD EPC contract and the NITI Aayog model agreements, as well as the ICC, SIAC, LCIA, UNCITRAL and IBA instruments. Statutory material includes the Arbitration and Conciliation Act, 1996, the Mediation Act, 2023, the Contract Act, 1872 and the evolving law on stamping. Detailed chapter sub-headings and a Table of Cases make it easy to find the relevant authority.

The Handbook also covers the practical questions that come up once a dispute is under way. It examines the enforcement of bank guarantees and bonds, including the limited grounds of egregious fraud and special equities, and the role of surety bonds as an alternative form of security. It looks at the arbitral process in practical detail: hearing logistics, witness preparation, chess-clock time allocation and documents-only arbitration. Recent developments in enforcement are dealt with as well, such as challenges to unilateral appointment of arbitrators and the effect of third-party funding on disclosure and impartiality.
